What these two documents actually do
Most people come to us knowing they ought to sort something out, without being certain which document they need. Here is the short version.
A Lasting Power of Attorney
An LPA lets you choose people you trust to make decisions on your behalf if you ever lose the capacity to make them yourself. There are two types: one for property & financial affairs, one for health & welfare. Most people put both in place.
It can only be made while you still have the capacity to make it, which is why it is worth doing well before it is needed.
A Will
A will sets out what happens to your money, property and belongings after you die, and who is responsible for sorting it out. Without one, the law decides who inherits rather than you.
An LPA covers decisions while you are alive; a will covers what happens afterwards. They do different jobs, and most people need both.
